1. Agreement to These Terms
These Terms and Conditions ("Terms") govern your access to and use of the website operated for SFB Lofts, the residential community at the San Fernando Building, managed by Structure Properties, Inc. ("SFB Lofts," "we," "us," or "our"), including sfblofts.com and related pages (the "Site"). By accessing or using the Site, you agree to these Terms and to our Privacy Policy, which is incorporated by reference. If you do not agree, do not use the Site.
These Terms apply to the Site only. Your relationship with us as an applicant or resident is governed by the separate written agreements you enter into with us, such as a lease or rental application. If those agreements conflict with these Terms, those agreements control for that relationship.
2. Who May Use the Site
You must be at least 18 years old to use the Site. By using the Site, you represent that you meet this requirement and that the information you provide is accurate.
3. The Site Is Informational
Content on the Site, including descriptions of the community, amenities, floor plans, and available homes, is provided for general information. Availability, pricing, square footage, and terms change frequently and are not guaranteed until confirmed in a signed agreement. Nothing on the Site is an offer to lease, a guarantee of availability, or legal, financial, or tax advice. We work to keep information current and accurate but do not warrant that it is complete or error free.
4. Fair Housing
SFB Lofts is committed to equal housing opportunity. We comply with the federal Fair Housing Act and all applicable state and local fair housing laws, and we do not discriminate on any protected basis. We also comply with the Los Angeles Fair Chance Ordinance for Housing and other applicable local fair-chance requirements governing how criminal history is considered in the application process.
5. Third-Party Services and Links
The Site links to and integrates third-party services, including our resident portal and payment tools and our online application and screening tools (AppFolio), and tour-scheduling and listing platforms. Your use of those services is governed by their own terms and privacy policies. We do not control and are not responsible for third-party services, and links to them do not imply our endorsement.
6. Intellectual Property
The Site and its content, including text, graphics, logos, photographs, and the SFB Lofts and San Fernando Building names and marks, are owned by us or our licensors and are protected by intellectual property laws. We grant you a limited, revocable, non-exclusive license to view the Site for your personal, non-commercial use. You may not copy, reproduce, distribute, scrape, or create derivative works from the Site without our prior written permission.
7. Acceptable Use
You agree not to:
- use the Site in violation of any law or these Terms;
- interfere with or disrupt the Site or its security;
- access the Site through automated means such as bots or scrapers except as permitted by our robots file;
- misrepresent your identity or submit false information;
- upload anything unlawful, infringing, or harmful.
8. Submissions and Communications
If you submit information through the Site, such as a contact form or application inquiry, you confirm the information is accurate and that you have the right to provide it. You consent to be contacted by phone, email, and text as described in our Privacy Policy. Any feedback you send us may be used without restriction or obligation to you.
9. Disclaimer of Warranties
The Site is provided "as is" and "as available," without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Site will be uninterrupted, secure, or error free, or that content is accurate or current. Some jurisdictions do not allow the exclusion of certain warranties, so some of these exclusions may not apply to you.
10. Limitation of Liability
To the fullest extent permitted by law, SFB Lofts, Structure Properties, Inc., and their officers, employees, and agents will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, data, or goodwill, arising out of or related to your use of or inability to use the Site, even if we have been advised of the possibility of such damages. To the fullest extent permitted by law, our total liability for any claim arising out of or relating to the Site will not exceed one hundred dollars ($100). Some jurisdictions do not allow certain limitations, so some of these limitations may not apply to you.
11. Indemnification
You agree to indemnify and hold harmless SFB Lofts, Structure Properties, Inc., and their officers, employees, and agents from any claims, damages, losses, and expenses, including reasonable attorneys' fees, arising out of your use of the Site or your violation of these Terms, to the extent permitted by law.
12. Dispute Resolution and Arbitration
Except where prohibited by law, any dispute arising out of or relating to these Terms or the Site will be resolved by binding arbitration on an individual basis, and not in a class or representative action. Either party may seek relief in small claims court for qualifying claims.
13. Governing Law
These Terms are governed by the laws of the State of California, without regard to its conflict-of-laws rules. Subject to Section 12, any dispute not subject to arbitration will be brought in the state or federal courts located in Los Angeles County, California, and you consent to their jurisdiction.
14. Changes to These Terms
We may update these Terms from time to time. Changes take effect when posted, and the "Last Updated" date reflects the most recent version. Your continued use of the Site after changes are posted means you accept the updated Terms.
